A three-man panel of the Presidential Elections Petition Tribunal in
Abuja has granted the PDP, Atiku access to All
Electoral Materials in the presidential elections.
The three man panel headed by Justice Abdul Aboki and the other
two Peter Ige and Emmanuel Agim on
Wednesday heard the ex-parte motion filed by the PDP and its presidential
candidate, Atiku Abubakar, seeking an order granting them access to check
and inspect the electoral materials used for the February 23 presidential
elections.
An ex-parte motion at the Court of Appeal in Abuja was filed by
Abubakar Atiku asking for orders of the court to allow him to access and
inspect all the documents used by the Independent National Electoral Commission
(INEC) for the conduct of the presidential election that he was a candidate and
that he claimed was marred with untold and unprecedented rigging.
The ex-parte motion prayed for an order compelling INEC to allow
them to inspect the register and other vital documents used in the conduct of
the election unhindered.
In the delivered ruling, by the
three man panel, INEC was ordered to allow the appellant access to all
electoral material to enable the applicant file and maintain his petition
according to the electoral laws.
However, the court turned down the prayers 3 to 5 of the
petition which requested scanning and forensic audit. Stating that a
forensic audit was not covered under the terms envisaged by section 151 of the
electoral act.
The panel unanimously agreed to the ruling, hence the motion was
granted partly by the panel.
